  • University / Institution acts as Data Controller (GDPR) / Data Fiduciary (India DPDP Act)
  • Proctorly.ai acts as Data Processor under institutional instructions

2) What Data We Process

  • Student name, email, enrollment identifiers
  • Exam identifiers and attempt status
  • Webcam frames, screen recordings (configurable)
  • Device, network, and security logs

3) Why We Process Data

  • Secure authentication and exam access
  • Identity verification
  • Exam integrity monitoring
  • Auditability and dispute resolution

4) Legal Basis of Processing

GDPR

  • Performance of contract

India DPDP Act

Processing occurs under valid notice, consent, or permitted grounds defined by the University/Institution.

5) Proctoring & Human Review

Proctorly.ai may generate risk indicators. Final exam integrity decisions are made by authorized University personnel.

6) Data Retention

  • Proctoring evidence retained up to 2 days
  • Extended retention only with institutional authorization

7) Access Control

  • Authorized University personnel
  • Authorized Proctorly.ai staff for support
  • Role-based access control and audit logs

8) Data Sharing & Third Parties

Proctorly.ai does not sell personal data. Subprocessors operate under contractual safeguards.

9) Security Measures

  • Encryption in transit and at rest
  • Secure storage and access controls
  • Incident response procedures

10) International Data Transfers

Transfers are protected using DPAs and Standard Contractual Clauses where required.

11) Student Rights

Rights requests are handled via the University/Institution acting as Data Controller.

Institutions are responsible for obtaining required consents for minors.
