Proctorly.ai Terms of Service:
These Terms govern the access and use of Proctorly.ai, an online examination delivery and remote proctoring platform.
These Terms apply only to Proctorly.ai.
1) Parties
A) Institutional Use (Primary Model)
- University/Institution = customer and authorized administrator
- Students/Candidates = authorized users invited by the Institution
- Proctorly.ai = service provider
B) Student Use
Students access Proctorly.ai as part of an institution-managed exam. Proctorly.ai does not provide the exam content independently.
2) Scope of Services
- Exam access workflows and session handling
- Candidate authentication (via institutional SSO where enabled)
- Identity verification and integrity monitoring
- Exam evidence capture and reviewer tools (as configured)
- Exam audit logs and reporting
3) Authentication & SSO
- Institutional SSO using OAuth 2.0 / Identity Provider integration, where enabled
- Institution-issued credentials and authorized access methods
Proctorly.ai does not store institutional LMS passwords when OAuth/SSO is used.
4) Candidate Obligations
- Use their own identity and valid credentials
- Follow the institution’s exam rules and instructions
- Not use unfair means, impersonation, or prohibited materials
- Maintain proper exam environment as instructed
Violations may result in exam flagging, review, or action by the institution.
5) Proctoring Evidence & Exam Integrity
- Webcam frames / video
- Screen recording
- Exam event markers and logs
Evidence is accessible only to authorized institution personnel and retained as per institutional policy (e.g., 2 days).
6) Acceptable Use & Prohibited Activities
- Attempt to bypass monitoring controls
- Tamper with the platform
- Introduce malware or automation tools
- Access another user’s account or exam content
7) Confidentiality & Security
Proctorly.ai applies reasonable security safeguards. Institutions are responsible for role assignments, reviewer access control, and exam configuration governance.
8) Availability & Support
Proctorly.ai aims for reliable availability during exam windows but may conduct maintenance with prior notice where feasible.
9) Data Protection & Privacy
Use of Proctorly.ai involves processing personal data as described in the Proctorly.ai Privacy Policy.
- University = Controller / Fiduciary
- Proctorly.ai = Processor
10) Intellectual Property
Proctorly.ai retains ownership of platform software, algorithms, system design, and documentation. Universities retain ownership of exam content and student records.
11) Limitation of Liability
- Not liable for institutional disciplinary decisions
- Not responsible for candidate network or device constraints
- Liability limits may be governed by institutional contracts
12) Termination / Access Removal
The University/Institution may revoke student access at any time. Proctorly.ai may suspend access where misuse or security risk is detected.
13) Governing Law & Jurisdiction
Governing law may be defined by the commercial agreement and does not override mandatory local data protection laws.
